India Requires Proof of Innocence for Cyber Crimes

David Seltzer highlights a disturbing development in international computer crime law and is concerned that the United States may be going that way, too.  In India an individual charged with a cyber crime now has to prove their innocence.  Read more . . .

I think there is some concern over the way ISP's and Search Engines rollover too easily to law enforcement officials' request for information.  Just look at China, where all the major ISP's and search engines have had to quietly agree to make some information available.

On a related note, I have heard that there is a movement known as "Internet 2.0" (a play on Web 2.0?), which is a plan to re-work the entire internet to fix issues that were not thought of when it first started to emerge.

In conjunction with this, I have heard there is an agenda to really lock the internet down. It's already going to pot in Australia.

Unfortunately governments will always try to control information. They don't like wild wests. I'm afraid for the future of the internet in some respects.

I don't think that it will be possible for them to shut off the internet access to think that billions of subscribers will protest to what they are up to I think they wont have the guts to materialize that idea.

Bush is gone. It is much less likely that we will go that way.

oh, it is not impossible but i think it would be hard for the US governement to implement such things. Americans knew their rights and love freedom.

It is good that India is addressing offenses and taking cyber crimes seriously. That is commendable.

I would be pretty hard to control information via world wide web. However, it is possible. Question would be, would the government be that decisive about the law?

I find this hard to believe especially post-Bush. Government Information control has changed back in recent months.
But this definitely would be a scary thought!

It a step back in time, if you are guilty before proven innocent. The web is too big to stop now. They'll just have to find better ways to track cyber criminals.

I think over time what we´ll find is that governments that persist in this kind of control will be the ones that find themselves on the outer when elections come along.

Good to know India is going against the cyber criminals. Well as we know its hard to control information via web, but to prevent crimes Government should take some actions. World isn't safe now, Criminals are every where, whether its in your real life or in internet.

Hi it’s good to know that India is fighting against cyber crime. It requires lot of anti cyber crime technique to fight. Government will find very difficult to keep the information very safe. It should be the union of world’s country to fight against cyber crime.

I think to make that effective, every ISP in India must be static so that they can really monitor who have done the violation.
