Stupid Lawsuits: The Fundamental Right to Ride a Roller Coaster

A Florida woman is suing Walt Disney World for banning her from its Tower of Terror ride, saying riding it is a medical necesity.  Denise Mooty says the "G-forces of going up and down" the 199-foot thrill ride help break up fibrous adhesions in her abdomen.  Disney, she says, had decided to limit her to four rides a week, far fewer than the dozens her doctor has ordered.  Mooty was then banned, Disney says, "for causing a disturbance within the presence of other guests and using foul language toward a Cast Member."

I am curious why would Disney care how many times she rode the rollercoaster? If she paid the exhorbitant amount of money to get into the park, why would they tell her she had to limit her rides?

I can see why Disney would try and limit the amount of rides per week. I'm sure there is a health concern with riding so much.

the problem was she was banned coz of causing disturbance in walt disney. if she goes for a suing walt disney because of limit ride i don't think so if that rights can be a strong case against it. i think walts has also the right to limit for the good of her health. thank you for sharing.

It is Disney's roller coaster they have the right to do limit how often someone can use it, why not ? And if I were standing in line and found out that half of the people in front had been riding the damn ride all day I would be irritated.

As long as she would sign a liability waiver I don't see a problem with her riding it as much as she wants, espescially if she paid for entry to the park.

I'm sure it is up to the park since they take the liability if she would be injured in one way or another. I would hope they spell things out like this on the back of your ticket into the park.

Well if you can be bothered to keep queing up and riding then I dont see anything wrong with that. Just cause the person in front of me has been on the ride already I dont see why that is an annoyance? they just want to ride again.

It's very interesting how Disney makes their case against Ms. Mooty and her quest to ride the Tower of Terror as much as she want. While they are not really admitting that there is a personal injury liability case waiting in the wings if they allow her on the ride all day long, they are obviously working to keep her off the ride. Disney is a great marketing company and there have been a few cases of injuries on this ride in recent years that does not help their image of being a safe family park.

As a former Cast Member, we encountered many unusual things in the parks and this was really no different. She could have gone on the ride numerous times without a notice until she brought attention to her condition which I could understand the liability concerns of the park.
